Federal and state historic preservation laws require agencies to consult with the State Historic Preservation Office to review some government projects for impacts to historic places. The type of review generally depends on whether federal, state, or local government funding or approval are required for the project.
How to Determine if a Federal, State, or Local Project Requires SHPO Review

A project is subject to federal historic preservation law and SHPO review if a federal agency:
- owns the property involved in the project
- carries out the project on its own behalf
- provides federal funding for the project
- issues a federal permit to carry out any aspect of the project
- provides authorization to carry out any aspect of the project
And:
- the historic property affected is eligible for, or listed in, the National Register of Historic Places.

A state agency project is subject to state historic preservation law and SHPO review if a state agency:
- owns the historic property involved in the project
- carries out the project on its own behalf
- provides funding for the project
- issues a permit to carry out any aspect of the project
- provides authorization to carry out any aspect of the project
And:
- the historic property affected by the project is recorded in the Wisconsin Historic Preservation Database (WHPD)
- There is no federal level of involvement in the project

A local government project is subject to SHPO review if the city, village, town, or county:
- owns the historic property
- engages in long-range planning
- provides funding for the project
- issues a permit to carry out any aspect of the project
- transfers or leases a government-owned historic property
And:
- the historic property affected by the project is listed in the State Register or National Register of Historic Places
- there is no federal or state level of involvement in the project
